1. Scope of Application

These Terms and Conditions govern all accommodation agreements between the guest and Nivara Hotel, Steindamm 10, 20099 Hamburg, Germany (hereinafter referred to as “the Hotel”).

They apply to bookings made directly via the hotel website, email, telephone, or through third-party booking platforms (e.g., Booking.com, Expedia, etc.).

By confirming a reservation, the guest accepts these Terms and Conditions.

2. Conclusion of Contract

An accommodation contract is concluded when:

• The Hotel confirms the booking in writing (email confirmation), or

• An automatic confirmation is generated through the online booking system.

For reservations made via third-party platforms, their terms apply in addition to these Terms.

3. Rates and Payment

All prices are stated in EUR and include applicable statutory VAT.

The Hotel reserves the right to:

• Pre-authorize credit cards prior to arrival

• Require advance payment

• Cancel reservations if valid payment details are not provided

Non-refundable rates require full prepayment.

4. Check-in and Check-out

• Standard Check-in: from 15:00

• Standard Check-out: until 11:00

Early check-in and late check-out are subject to availability and may incur additional charges.

If self-check-in is used, guests will receive digital access instructions prior to arrival. Access credentials must not be shared with third parties. The guest is responsible for any misuse of access credentials.

5. Cancellation Policy

Cancellation terms depend on the booked rate:

Flexible Rate

Free cancellation within the cancellation period specified in the booking confirmation. After this period, at least the first night may be charged.

Non-Refundable Rate

No free cancellation permitted. The total booking amount will be charged in case of cancellation or no-show.

6. No-Show

In the event of a no-show without prior cancellation, the Hotel reserves the right to charge the applicable amount according to the booking conditions.

The Hotel may release the room after the first night.

7. House Rules

• Smoking is strictly prohibited throughout the building.
  → Violation will result in a cleaning fee of EUR 250.

• Quiet hours are from 22:00 to 07:00.

• Parties or events are not permitted without written consent.

• Pets are allowed only upon prior approval.

• Tampering with smoke detectors or fire safety equipment will result in immediate termination of the stay without refund.

Serious violations may lead to immediate termination of the accommodation contract without reimbursement.

8. Guest Liability

Guests are liable for any damage caused to the Hotel property by themselves or accompanying persons.

In case of loss of keys or digital access devices, a replacement fee may apply.

9. Hotel Liability

The Hotel is liable only in cases of intent or gross negligence.

Liability for items brought into the Hotel is governed by German statutory provisions (§§ 701 et seq. German Civil Code – BGB).

Guests are advised to secure valuables appropriately.

10. Identification Requirement

Guests are required to present a valid government-issued photo ID upon check-in.

The Hotel reserves the right to verify identity prior to granting access.

11. Force Majeure

The Hotel shall not be liable for failure to perform obligations due to events beyond its reasonable control (e.g., natural disasters, government restrictions, strikes).

12. Data Protection

Personal data is processed in accordance with applicable data protection laws, including the GDPR. Details are available in the separate Privacy Policy.

13. Governing Law and Jurisdiction

German law applies.

To the extent legally permissible, the place of jurisdiction shall be Hamburg, Germany.
