1. Scope of Application<\/h2>

These Terms and Conditions govern all accommodation agreements between the guest and Nivara Hotel, Steindamm 10, 20099 Hamburg, Germany (hereinafter referred to as \u201cthe Hotel\u201d).<\/p>

They apply to bookings made directly via the hotel website, email, telephone, or through third-party booking platforms (e.g., Booking.com, Expedia, etc.).<\/p>

By confirming a reservation, the guest accepts these Terms and Conditions.<\/p>

2. Conclusion of Contract<\/h2>

An accommodation contract is concluded when:<\/p>

  • The Hotel confirms the booking in writing (email confirmation), or<\/p><\/li>

  • An automatic confirmation is generated through the online booking system.<\/p><\/li><\/ul>

    For reservations made via third-party platforms, their terms apply in addition to these Terms.<\/p>

    3. Rates and Payment<\/h2>

    All prices are stated in EUR and include applicable statutory VAT.<\/p>

    The Hotel reserves the right to:<\/p>

    • Pre-authorize credit cards prior to arrival<\/p><\/li>

    • Require advance payment<\/p><\/li>

    • Cancel reservations if valid payment details are not provided<\/p><\/li><\/ul>

      Non-refundable rates require full prepayment.<\/p>

      4. Check-in and Check-out<\/h2>

      • Standard Check-in: from 15:00<\/p><\/li>

      • Standard Check-out: until 11:00<\/p><\/li><\/ul>

        Early check-in and late check-out are subject to availability and may incur additional charges.<\/p>

        If self-check-in is used, guests will receive digital access instructions prior to arrival. Access credentials must not be shared with third parties. The guest is responsible for any misuse of access credentials.<\/p>

        5. Cancellation Policy<\/h2>

        Cancellation terms depend on the booked rate:<\/p>

        Flexible Rate<\/h3>

        Free cancellation within the cancellation period specified in the booking confirmation. After this period, at least the first night may be charged.<\/p>

        Non-Refundable Rate<\/h3>

        No free cancellation permitted. The total booking amount will be charged in case of cancellation or no-show.<\/p>

        6. No-Show<\/h2>

        In the event of a no-show without prior cancellation, the Hotel reserves the right to charge the applicable amount according to the booking conditions.<\/p>

        The Hotel may release the room after the first night.<\/p>

        7. House Rules<\/h2>

        • Smoking is strictly prohibited throughout the building.
          \u2192 Violation will result in a cleaning fee of EUR 250.<\/p><\/li>

        • Quiet hours are from 22:00 to 07:00.<\/p><\/li>

        • Parties or events are not permitted without written consent.<\/p><\/li>

        • Pets are allowed only upon prior approval.<\/p><\/li>

        • Tampering with smoke detectors or fire safety equipment will result in immediate termination of the stay without refund.<\/p><\/li><\/ul>

          Serious violations may lead to immediate termination of the accommodation contract without reimbursement.<\/p>

          8. Guest Liability<\/h2>

          Guests are liable for any damage caused to the Hotel property by themselves or accompanying persons.<\/p>

          In case of loss of keys or digital access devices, a replacement fee may apply.<\/p>

          9. Hotel Liability<\/h2>

          The Hotel is liable only in cases of intent or gross negligence.<\/p>

          Liability for items brought into the Hotel is governed by German statutory provisions (\u00a7\u00a7 701 et seq. German Civil Code \u2013 BGB).<\/p>

          Guests are advised to secure valuables appropriately.<\/p>

          10. Identification Requirement<\/h2>

          Guests are required to present a valid government-issued photo ID upon check-in.<\/p>

          The Hotel reserves the right to verify identity prior to granting access.<\/p>

          11. Force Majeure<\/h2>

          The Hotel shall not be liable for failure to perform obligations due to events beyond its reasonable control (e.g., natural disasters, government restrictions, strikes).<\/p>

          12. Data Protection<\/h2>

          Personal data is processed in accordance with applicable data protection laws, including the GDPR. Details are available in the separate Privacy Policy.<\/p>

          13. Governing Law and Jurisdiction<\/h2>

          German law applies.<\/p>
